Acceptable Use Policy

This Acceptable Use Policy (the "AUP") governs your use of the Cachee platform and related services (the "Service") provided by Appuix, Inc. ("Company," "we," "us," or "our"). This AUP is incorporated into and forms part of our Terms of Service. Capitalized terms not defined herein have the meanings assigned in the Terms of Service.
By accessing or using the Service, you agree to comply with this AUP. We may update this AUP from time to time, and your continued use of the Service constitutes acceptance of any changes.
1. General Requirements
You agree to use the Service only for lawful purposes that are consistent with these Terms, the Documentation, and all applicable laws and regulations. You are responsible for ensuring that your Authorized Users and end users also comply with this AUP. You must not use the Service in any way that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service.
2. Prohibited Activities
You may not use the Service, directly or indirectly, for any of the following purposes:
A. Illegal or Harmful Activities
- Engaging in any activity that violates any applicable federal, state, or local law, regulation, or ordinance.
- Facilitating, promoting, or encouraging illegal activity, including fraud, identity theft, money laundering, or terrorist financing.
- Processing data or conducting transactions related to illegal substances, illegal gambling, or other illegal goods or services.
- Using the Service to stalk, harass, threaten, defame, or intimidate any person.
- Using the Service to distribute malware, viruses, worms, Trojan horses, or other malicious code or harmful technology.
B. Unauthorized Access and Security Violations
- Attempting to gain unauthorized access to the Service, other customer accounts, or any computer systems or networks connected to the Service.
- Probing, scanning, or testing the vulnerability of the Service or any related system or network without Company's prior written authorization.
- Circumventing, disabling, or otherwise interfering with security features of the Service, including authentication, access controls, encryption, or rate limiting.
- Using the Service to intercept, collect, or store data from other users without their explicit consent.
- Attempting to reverse engineer, decompile, disassemble, or otherwise derive the source code, algorithms, or underlying technology of the Service.
C. Abuse of Service Resources
- Using the Service in a manner that consumes an unreasonable or disproportionate amount of infrastructure resources, including bandwidth, storage, or processing capacity.
- Launching or facilitating denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against the Service or any third party.
- Employing automated scripts, bots, or crawlers to access the Service in a manner not authorized by the Documentation or exceeding published rate limits.
- Submitting intentionally corrupted, falsified, or synthetic data designed to degrade the performance or accuracy of the Service.
D. Violations of Data Privacy and Biometric Laws
- Collecting, storing, or processing biometric data without obtaining all legally required consents and providing all legally required notices to the individuals whose data is being processed.
- Using the Service to conduct covert or non-consensual surveillance of individuals.
- Using the Service in any manner that violates the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Act, the Washington Biometric Identifiers statute, the California Consumer Privacy Act (CCPA), or any other applicable privacy or data protection law.
- Failing to maintain or follow a publicly available data retention and destruction schedule as required by applicable biometric privacy laws.
- Selling, leasing, trading, or otherwise profiting from the biometric data of individuals processed through the Service, except as expressly permitted by applicable law and with the individual's informed consent.
E. Intellectual Property and Content Violations
- Using the Service to infringe, misappropriate, or violate the intellectual property rights, publicity rights, or privacy rights of any third party.
- Uploading, transmitting, or storing content that you do not have the right to use or that infringes the copyrights, trademarks, or other rights of any third party.
- Using Company's trademarks, logos, or branding in any manner that implies endorsement, sponsorship, or affiliation without Company's prior written consent.
F. Competitive Use
- Accessing or using the Service to build, train, or improve a competing product or service, whether directly or through a third party.
- Using the Service to conduct benchmarking, competitive analysis, or performance testing for purposes of developing or marketing a competing offering without Company's prior written consent.
- Reselling, sublicensing, or redistributing the Service or any portion thereof without Company's prior written authorization.
G. Misrepresentation
- Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with any person or entity.
- Providing false, misleading, or inaccurate information in connection with your account registration or use of the Service.
- Using the Service to create or propagate deceptive, fraudulent, or misleading identity credentials.
3. U.S.-Only Availability; No Circumvention
The Service is currently available only within the United States. You may not access or use the Service from any jurisdiction outside the United States. You may not use a virtual private network (VPN), proxy, or any other tool or method to circumvent geographic restrictions or to disguise your location. Any attempt to access the Service from outside the United States, or to assist others in doing so, constitutes a violation of this AUP and the Terms of Service.
4. Enforcement
Company reserves the right to investigate any suspected violation of this AUP and to take any action it deems appropriate, including but not limited to:
- Issuing a warning to the violating party;
- Temporarily suspending access to the Service;
- Permanently terminating the violating party's account;
- Removing or disabling access to any content or data that violates this AUP;
- Reporting suspected illegal activity to appropriate law enforcement authorities;
- Pursuing any available legal remedies.
Company's decision to take or refrain from taking any enforcement action does not constitute a waiver of its right to enforce this AUP in the future. Company may, in its sole discretion, determine whether a violation of this AUP has occurred.

We encourage responsible reporting and will review all reports promptly. We will not retaliate against any person who reports a suspected violation in good faith.
